§ 1 Definitions
- Order - a declaration of will submitted by the Customer leading to the conclusion of a contract with the Seller, which the Customer submits by filling in the forms of the online shop and specifying the type and number of Products and the price.
- Product - the item sold at www.vitberg.com.
- the Vitberg online shop - an online service that enables the Ordering of Products.
- customer - an individual (consumer), company or other entity making an order in the Online Shop.
§ 2 General provisions
- The Seller in the Vitberg online shop (hereinafter referred to as the shop) with the electronic address www.vitberg.com is the Company Vitberg Jacek Sikora, with the registered office at ul. Marcina Borelowskiego 29, 33 -300 Nowy Sącz, entered in the Central Register and Information on Business Activity (CEIDG) maintained by the Minister responsible for economy, NIP: 734-100-91-12, REGON: 490746866.
- Contact with the shop is possible via e-mail biuro@vitberg.com, phone: 500 280 980. Every person should read the shop regulations before using the shop. In matters not regulated by the Rules, the generally applicable regulations for online sales apply.
- Making purchases in the shop requires an active and functioning e-mail account.
- The Vitberg RS2 apparatus with specialised modules and Personal Protective Equipment are sold through the shop.
- The products offered for sale in the shop are new and free from physical and legal defects.
- The products are guaranteed for two years. An extension of the guarantee period may result from a chargeable extension by the customer.
- The commercial information on the website does not constitute an offer within the meaning of the Civil Code and cannot constitute a basis for a contract, but is to be regarded as an invitation to tender.
- Making a purchase in the online shop www.vitberg.com is tantamount to acceptance of these regulations.
- The Seller reserves the right to change the Terms and Conditions, in particular due to changes in the law, payment or delivery conditions which are beyond the Seller's control.
§ 3 Terms and conditions of electronic service
- In order to successfully make a purchase in the vitberg.com online shop, the customer should:
- access to the Internet,
- a web browser with JavaScript and cookies,
- e-mail account.
§ 4 Order processing and dispatch
- Unless otherwise stated in the current offer, the cost of delivery and collection shall be borne by the customer.
- The condition for the conclusion of the contract is that the customer sends an offer to purchase the goods by means of a form on the shop's website, by e-mail or by telephone and the online shop accepts it.
- the price of the consignment is given at the time of order fulfilment, when you go to complete the shopping cart.
- The condition for the release of the goods is payment for the goods and shipment.
- The price is binding on both parties at the time the order is placed.
- The current lead time is stated during the ordering process.
- The prices of the goods are gross prices and include VAT in accordance with the applicable tax law (8% or 23% VAT).
- The form of payment is determined individually by the Customer. The Seller accepts the following forms of payment: imoje, bank transfer, quick transfer, BLIK, Google Pay, Apple Pay and others, as long as such are available in the payment methods when processing the order on vitberg.com.
§ 5 Delivery
- On the territory of Poland the transport service is provided by GLS, international shipments are handled by Poczta Polska Global Express or UPS. The transport company may be different as long as this does not affect the quality and conditions of the transport service, and this decision is made by the seller.
- The place of delivery is the place indicated by the Customer in the order. The seller (shop) is not responsible for any incorrect address.
- Personal data are protected and processed for the purpose, at the time and to the extent specified in the Privacy Policy available on vitberg.com.
- The cost of delivery, unless it is free of charge, is borne by the Customer and the information about its amount is calculated each time in the shopping cart on the basis of the number and type of added products and the current price lists of companies indicated in pt. 1, and the value of the delivery is included and specified in the purchase document and ranges from PLN 10 to 600 depending on the size, shipments outside Poland are priced individually.
§ 6 Right of withdrawal
- On the basis of the Consumer Rights Act of 30 May 2014. A consumer who has concluded a contract at a distance or off-premises may withdraw from the contract within 14 days without stating a reason and without incurring costs. Sending the declaration of withdrawal before the deadline is sufficient to meet the deadline.
- The consumer may withdraw from the contract by submitting a declaration of withdrawal to the Seller. The declaration can be made on the form , a specimen of which can be downloaded from vitberg.com.
- The consumer shall return the goods to the Shop within 14 days of the declaration of withdrawal from the contract. The returned goods should be complete.
- The Seller shall reimburse all payments made by the Consumer immediately, but not later than within 14 days of receipt of the withdrawal declaration. The Seller shall refund the payment using the same method of payment used by the Consumer, unless the Consumer has expressly agreed to a different method of refund. The Seller may withhold reimbursement of payments received from the Consumer until it has received the goods returned by the Consumer.
- Pursuant to Article 38 of the Consumer Rights Act, a consumer has no right of withdrawal from an off-premises or distance contract with respect to contracts in which the subject of the performance is an item supplied in sealed packaging which cannot be returned for health protection or hygiene reasons after opening the packaging, if the packaging has been opened after delivery.
- If the return is the fault of the customer, the shipping charges will be deducted from the amount to be refunded.
- Entrepreneurs making non-business purchases shall have the right to withdraw from the contract within 14 days .
§ 7 Complaints
- The Vitberg online shop shall be liable to the Customer for any lack of conformity of the Product with the Sales Contract from the moment of its delivery to the Customer and revealed within a period of two years starting from that date.
- The Vitberg online shop shall not be liable for the lack of conformity of the Product with the sales contract if the Customer, at the latest at the time of the conclusion of the Contract, has been informed by the Vitberg online shop of the fact that a specific feature of the Product deviates from the conformity with the Contract and has accepted in writing (e.g. by e-mail) the lack of a specific feature of the Product.
- If the Product does not comply with the sales contract, the Customer shall be entitled to repair or replace the Product.
- The Vitberg Online Shop may replace the Product when the Customer requests a repair, or the Vitberg Online Shop may repair the Product when the Customer requests a replacement if bringing the Product into conformity with the Contract of Sale in the manner chosen by the Customer is impossible and involves excessive costs for the Vitberg Online Shop. If both of the above are impossible for the Vitberg Online Shop to fulfil, the Customer may make a declaration to reduce the price or withdraw from the Contract.
- The Vitberg Online Shop shall repair or replace the Product within 14 days of delivery of the Product to the Vitberg Online Shop.
- The cost of repairing or replacing the Product shall be borne by the Vitberg Webshop. The Customer shall make the Product available for collection by the Vitberg Webshop and this shall be at the expense of the Vitberg Webshop.
- The Vitberg online shop may not accept the Consumer's declaration of withdrawal from the Sales Contract if it demonstrates that the lack of conformity of the Goods with the Sales Contract is insignificant.
- Any complaints relating to the performance of the Sales Contract may be submitted by the Customer by e-mail or in writing to the address of the Vitberg Online Shop. The Vitberg Online Shop will respond to the complaint within 14 days starting from the day of delivery of the product to the Shop.
§ 8 Personal data
- The Seller, in connection with the performance of the contract, undertakes to comply with the regulations covering the protection of personal data (RODO), on the basis of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons in relation to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation) and the Act of 10.05.2018 on the protection of personal data (i.e. Journal of Laws 2019.1781). Personal data are protected and processed only for the purpose and to the extent that is necessary for the sales process. § 9 Dispute resolution
- In the event of the Customer's dissatisfaction with the service or in connection with the failure to act as the Vendor is obliged to do, the Customer shall in any case be entitled to seek mediation, use the online consumer dispute resolution system: http://ec.europa.eu/consumers/odr/, or take legal action before a court of competent jurisdiction.
